Jim Francis Presents CLE on Consumer Finance

On September 16, 2020, founding partner Jim Francis delivered a Continuing Legal Education (CLE) presentation discussing class actions pertaining to the Fair Credit Reporting Act (FCRA). Attorneys in most U.S. states must complete a minimum number of CLE credits in order to maintain their license to practice law. This presentation, produced by Strafford Publications, was in the form of a live webinar followed by an interactive question and answer session.

During his presentation, Mr. Francis noted that the FCRA protects the following primary interests with respect to consumer credit reporting:

  • Accuracy
  • Privacy
  • Disclosure

Furthermore, the FCRA provides that entities that fail to comply with the law may be liable to consumers for damages. Mr. Francis used several cases filed by Francis Mailman Soumilas, P.C. to illustrate class certifications in FCRA litigation, including the following:

  • Ramirez v. TransUnion, LLC, 951 F.3D 1008 (9th 2020)
  • Patel v. TransUnion, LLC, 308 F.R.D. 292 (N.D. Cal, 2014), 2018 WL 1258194 (N.D. Cal. March 11, 2018)
  • Thomas v. Equifax Info. Services, LLC, No. 18-cv-684 (E.D. Va.)
  • Clark v. Experian Info. Sols., Inc., No. 16-cv-32 (E.D. Va.)
  • McIntyre v. Realpage, Inc., 2020 WL 5017612 (E.D. Pa. 8/25/20)-23(f) pending

The CLE course also included presentations by other attorneys discussing class action developments related to the Telephone Consumer Protection Act (TCPA) and the Federal Debt Collection Practices Act (FDCPA).
