US Government Intervenes In Proposed Class Action Regarding FCRA Constitutionality

General Information Services Inc. was sued by a plaintiff in a proposed class action claiming that GIS provided prohibited information to a potential employer in a background check report.

GIS claimed the Fair Credit Reporting Act was unconstitutional, stating that the provision prohibiting reporting criminal convictions older than seven years violates the First Amendment. The government moved to intervene to defend the constitutionality of the FCRA provision.
